Terms and conditions of ”Wojas Sms Discount Club” program
I. GENERAL PROVISIONS
These Regulations define the terms and conditions of participation in the "WOJAS SMS CLUB" Program.
1. Definitions
a. Organiser - Wojas S.A. with its registered office in Nowy Targ (34-400), at ul. Szewska 8, Poland.
b. Program - mobile messaging program (marketing and loyalty program) under the name "WOJAS SMS CLUB" conducted by the Organiser according to the terms and conditions specified in these Regulations.
c. Regulations - specify the conditions of participation in the Program and are available in WOJAS stores in Poland and on the website www.wojas.eu/sms-club.
d. Participant - a person who expresses his/her wish to receive special discounts via SMS. The condition for participating in the Program is sending an SMS with the content "WOJAS" to the number +48 882 975 150.
e. Declaration of Accession - a declaration of the Participant, expressed by sending an SMS with the content "WOJAS" to the number +48 882 975 150. The rate of the SMS applies and its cost varies depending on the rate of the telecommunication service provider.
f. SMS Coupon - an SMS message sent to the Participant by the Organiser containing a promotional code authorising the Participant to use the Promotion in question. The sender of the SMS coupon is Wojas. An SMS coupon sent from a sender marked otherwise is invalid. Coupons received do not add up, nor combine with other promotions and discounts.
g. Promotions - discounts, coupons or other rebates on goods or services offered to Participants by the Organiser in the WOJAS stores described in the Annex to the Regulations.
h. GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.
i. Act - Act of 10 May 2018 on the protection of personal data (Journal of Laws 2018, item 1000).
II. PRINCIPLES OF THE PROGRAM
1. The aim of the Program is to offer Participants special discounts and rebates to be used in Wojas stores in Poland and the online shop at www.wojas.eu.
2. You may become a Participant of the Program only under the condition of being a natural person having full legal capacity and submitting the Declaration of Accession in the manner described in par. 1 pt. 1 e.
3. Submission of the Declaration of Accession, acceptance and use of the SMS Coupon constitutes an expression of the Participant's willingness to participate in the Program under the terms of the Terms and Conditions and the Annex to the Terms and Conditions in its current version.
III. ACCESSION AND PARTICIPATION IN THE PROGRAM
1. Submission of the Declaration of Accession, described in par. 1, point 1 e, is a condition for participation in the Program.
2. By submitting the Declaration of Accession, the Participant accepts the Terms and Conditions of “WOJAS SMS CLUB” and agrees to participate in the marketing Programs organised by the Organiser, in particular, to receive related SMS messages.
IV. SMS COUPON
1. A Participant applying to the Program by following the Regulations and meeting, in particular, the conditions referred to in par. 1, point 1 e of the Terms and Conditions will receive information in the form of an SMS to welcome him/her to the WOJAS SMS Club.
2. The Participant will receive special offers in the form of SMS Coupons sent to the Participant's mobile phone number from which the Participant applied for the Program in the form of an SMS message.
3. In order to use the SMS Coupon, the Participant is obliged to present the received SMS Coupon to the salon staff before the transaction is finalised by the staff of WOJAS Company salons. The discount will be calculated from the total final value of the Participant's purchase. The discount will be calculated only on the assortment that assortment in regular prices.
4. The SMS Coupon must be used by the Participant in accordance with the time limit specified in the content of the SMS. After this time, the SMS Coupon becomes invalid and does not entitle the Participant to receive a discount.
5. The SMS Coupon may be granted to the Participant only once.
6. The SMS Coupon can be redeemed while shopping in Wojas stores and at www.wojas.eu. The SMS Coupon is not exchangeable for cash or any other type of benefit. The Participant is not entitled to any type of compensation or gratification from the Organiser for not using the SMS Coupon.
V. COMPLAINTS
1. The Participant has the right to file a complaint regarding the Program. The Participant shall file the complaint in writing to the Organiser's headquarters, with the annotation on the envelope "DISCOUNT FOR SMS". The complaint may be filed in accordance with the Act of 27 July 2002 on special conditions of consumer sales and amending the Civil Code or the Civil Code.
2. The complaint should contain the Participant's data: first name, surname, correspondence address, e-mail address, the mobile phone number from which the Participant applied for the Program, and the reason for the complaint. The Organiser will make every effort to resolve complaints without delay from the receipt date. The Participant will be notified of the resolution of the complaint immediately by e-mail to the e-mail address provided in the complaint application or by a letter.
VI. CANCELLATION OF PARTICIPATION IN THE PROGRAM
1. The Participant may cancel the participation in the Program at any time without giving any reason.
2. If the Participant does not wish to continue participating in the Program, the Participant agrees to reply to any mobile message from the Organiser in order to opt out of the Program. The cost of the opting-out message is at a charge corresponding to the Participant’s service provider’s tariff.
VII. CHANGES IN THE REGULATIONS
1. the Organiser will notify the Participants of any changes to the terms and conditions of the Regulations or the Program, at least 5 days in advance, through announcements posted on the website www.wojas.eu and in Wojas stores in Poland.
2. Using the SMS Coupon constitutes acceptance by the Participant of the Terms and Conditions in their currently valid version.
VIII. DURATION OF THE PROGRAM
1. The Program is valid indefinitely.
2. The Organiser reserves the right to suspend or terminate the Program at any time, without giving reasons. Participants will be informed about the suspension or termination of the Program at least 5 days in advance in announcements posted on www.wojas.eu and in Wojas stores in Poland.
3. The suspension or termination of the Program will take place on the date specified by the Organiser.
4. In the case of suspension or termination of the Program, the SMS Coupons will lose their validity and will not entitle to claim redemption.
IX. PARTICIPANTS' DATA
1. Before joining the Program, the Participant voluntarily consents to the processing of data by the Organiser. The Participant's data will be processed in the manner provided for in the Regulations, in particular, the mobile phone number, from which the Participant sent an SMS message, and/or e-mail address, name and surname, date of birth, which the Participant provided in the form on the website www.facebook.com/WojasPolska tab "RABAT SMS", for purposes connected with the Program, as well as for purposes connected with marketing the products or services of the Organiser and to receive from the Organiser commercial information electronically in the meaning of the Act on Rendering Electronic Services, by receiving SMS messages and/or EMAIL.
2. The administrator of the Participant's personal data is the Organiser, who processes the data for the purposes referred to in para. 1 and who may, in this respect, entrust data processing to other entities on the basis of a data processing agreement.
3. Personal data within the meaning of GDPR shall be processed in accordance with the applicable legal regulations.
4. The legal basis for the processing of personal data is the voluntary consent of the data subject - Article 6(1)(a) GDPR.
5. The personal data will be processed for the duration of the Program and after its termination for the period of limitation of possible claims.
6. The data subject shall have the right to request from the Administrator access to such data, rectification, erasure, restriction of processing, objection to processing, and transfer of personal data.
7. The consent expressed by the Administrator, may be withdrawn at any time. The withdrawal of consent shall not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal.
8. A participant whose data is processed has the right to lodge a complaint with a supervisory authority.
9. Provision of personal data is a condition for participation in the "WOJAS SMS CLUB" Program.
10. The consent to receive commercial information by electronic means is referred to in par. 1. The Participant may withdraw it in the manner described in par. 6.
X. FINAL PROVISIONS
1. All correspondence related to the Terms and Conditions and the Program should be sent in writing to the Organiser's headquarters or by electronic mail to the following address: club@wojas.eu.
